Terms of Use

This website is published by Longevity Property Group Limited, a company registered in Hong Kong SAR under company number 80416491 (“we”, “us”). Full details are in the Imprint. By using the site you accept these terms. If you do not accept them, please do not use the site.

1. What this website is

The site describes a residential development at Plai Laem, Koh Samui, Surat Thani, Thailand, and the terms on which residences in it are offered. It is marketing material. It is published so that somebody considering a purchase can understand what is being built and decide whether to start a conversation.

2. What this website is not

Nothing on this site is an offer capable of acceptance, an invitation to invest, a prospectus, or financial, tax, legal or investment advice. Nothing on it creates a reservation, an option or any other right over a residence. No residence is sold, reserved or paid for through this website: the forms send an enquiry and nothing more, and we take no payment online.

A purchase is made only under a separate signed contract. Where that contract and this website differ, the contract governs and this website is of no effect. Do not rely on anything here in place of reading it.

3. Sales are governed by the purchase contract, not by this page

These terms cover your use of the website. They do not cover the sale of a residence, and they are not a summary of the sale. Payment schedules, completion, handover, defects, cancellation, the fixed return, the buy-back option and the lease are all dealt with in the purchase contract, which names its own governing law and its own forum and which deals with land in Thailand under Thai law. Ask for a draft and take independent advice on it before you sign.

4. Figures, renders and the calculator

Two things stated on this site are contractual and should be read as written. The fixed return is contractual and runs for three years; what follows it is market-based and is not promised. The buy-back is an option exercisable within 36 months on the terms set out in the contract.

Beyond that contractual term, every yield, growth or return figure shown on this site — including anything produced by the calculator on the investment page — is a model built from assumptions you choose yourself. It is not a forecast, not advice, and not a commitment by us. Past performance and published market indices do not predict future results. Property values and rental income can fall as well as rise, and currency movement can change the result again.

Renders, floor plans, areas and unit counts are indicative, subject to construction tolerance and to changes required by the authorities. Photographs of Koh Samui show the island generally and are not photographs of the site unless captioned as such.

The residences are held on a 30-year lease registered at the Land Office in the buyer’s name, with a renewal option written into the contract. Under Thai practice a pre-agreed automatic renewal is not enforceable against a future owner of the land. It is an option, and we describe it as one.

5. Using the site

You may read the site, and print or save pages, for your own use. You may not:

• copy, republish, sell or redistribute any part of it, or use it to build a competing offer or listing;
• use any of it — text, renders, plans or photography — to train, fine-tune or ground a machine learning model, or scrape it for that purpose;
• submit false, misleading or third-party details through the forms, including somebody else’s name, e-mail address or telephone number without their knowledge;
• attempt to gain access to any part of the site, server or database you have not been given access to, or probe, scan or test it for weaknesses;
• interfere with the site’s operation, send it automated traffic at a rate a person could not generate, or introduce anything malicious into it;
• use it in breach of the law of the country you are reading it from.

Our forms are rate-limited and abuse is logged. We may withdraw access to the site or to the agency portal where these terms are broken.

6. Enquiries and the details you send us

When you send an enquiry or request the brochure you give us your name and contact details, and you tick a box confirming you have read the Privacy Policy. We use those details to answer you and, where you have agreed, to follow up. Please send us only details that are yours and that are accurate: we act on them, and a sales team calling a number that was never yours is a problem for whoever owns it.

What happens to that data afterwards — who sees it, where it goes, how long we keep it and how to have it deleted — is set out in the Privacy Policy, which forms part of these terms.

7. The agency portal

Registered partner agencies have accounts in a separate portal, used to register buyers and track referral protection. If you hold one:

• the account is yours, it is not transferable, and you are responsible for what is done with it;
• keep the credentials confidential, and tell us at once if you think they are known to somebody else;
• register only buyers who know you are registering them and who have agreed to it. You are responsible for having the lawful basis to pass us their details, and for telling them you have done so;
• referral protection runs for the period stated in the portal from the date of a valid registration, and a duplicate of a buyer already registered by another agency or already known to us does not create protection;
• commission is payable under the separate agency agreement, not under these terms and not under anything the portal displays.

We may suspend or close an account that registers buyers without their knowledge or that submits registrations in bulk.

8. Intellectual property

The content of this site — text, renders, plans, photography, film, the marks and the design — is owned by us or licensed to us and is protected by copyright. It may not be reproduced, distributed or used to train a model without written permission. Third-party photography is used under licence; map data is credited on the map itself to Esri, HERE, Garmin and OpenStreetMap contributors.

If you believe something on this site infringes your copyright, write to sales@longevitysamui.com with the page address, identification of the work and a statement of your rights in it. We will review it and remove or credit the material where the claim is good.

9. Third-party services on this site

Some parts of the site are provided by other companies, and using them means loading their code or their data into your browser:

These services have their own terms and their own privacy policies, and we do not control them. What each one receives, and what you can refuse, is set out in the Cookie Policy and the Privacy Policy.

10. Links to other sites

Where we link outward — for example to the Bank of Thailand’s property price index — we do so because the figure can be checked independently. We have no control over those sites, do not endorse them, and take no responsibility for their content or their availability.

11. Availability

We try to keep the site available and accurate, but we do not promise that it will be uninterrupted, error-free, or free of anything harmful. We may change, suspend or withdraw any part of it, including any residence shown on it, at any time and without notice. Prices and availability shown are indicative and change.

12. Liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow to be limited.

Subject to that, and to the fullest extent permitted by law, we exclude all liability arising from your use of this website or from reliance on anything shown on it. That includes loss of profit, loss of anticipated savings, loss of opportunity, and any indirect or consequential loss. This site is published as information: it sells nothing, takes no payment, and creates no right over a residence, and the statements in sections 2 and 4 about what it is and what its figures are set the basis on which it is offered.

This clause is about the website. Our obligations to a buyer are those in the purchase contract, and this clause does not reduce them.

13. Accessibility

We aim to meet WCAG 2.2 level AA. If any part of this site is difficult for you to use, write to sales@longevitysamui.com, tell us the page and what happened, and we will fix it and answer you. If you need information from a page in another form, ask and we will send it.

14. Changes to these terms

We may change these terms. The date at the top of this page is the date of the version you are reading, and that version governs your use of the site at the time you use it. Changes are not applied backwards.

15. Governing law, and your own law

These terms and your use of this website are governed by the law of the Hong Kong Special Administrative Region, and the courts of Hong Kong have non-exclusive jurisdiction over them. That governs the website only; a purchase is governed by the purchase contract, which deals with land in Thailand under Thai law.

If you are a consumer resident in the EU or the UK, you keep the protections of the mandatory law of your own country, including the right to bring proceedings there, and nothing on this page removes them. Consumers in the EU may also use the European Commission’s online dispute resolution platform. We are not obliged to take part in dispute resolution before a consumer arbitration board, and we do not.

If any part of these terms is found to be unenforceable, the rest continues to apply.
