4. What this website is, and is not
This site describes a residential development and the terms on which residences in it are offered. Nothing on it is an offer capable of acceptance, a prospectus, or financial, tax or legal advice. A purchase is made only under a signed contract, and that contract governs: where it and this website differ, the contract is what counts.
Two things are stated on this site and should be read as written. The fixed return is contractual and runs for three years; what follows it is market-based and is not promised. The buy-back is an option exercisable within 36 months on the terms set out in the contract. Beyond the contractual term, any yield or growth figure shown , including anything produced by the calculator on the investment page: is a model built from assumptions you set yourself, not a forecast and not a commitment by us.
The residences are held on a 30-year lease registered at the Land Office in the buyer’s name, with a renewal option written into the contract. Under Thai practice a pre-agreed automatic renewal is not enforceable against a future owner of the land. It is an option, and we describe it as one.
5. Images and plans
Renders, floor plans and areas are indicative and subject to construction tolerance and to changes required by the authorities. Photographs of Koh Samui show the island generally and are not photographs of the site unless captioned as such. Furniture The residences are handed over furnished, and the purchase contract sets out what that includes.
6. Copyright
The content of this site: text, renders, plans, photography, the marks and the design: is protected by copyright and may not be reproduced, distributed or used to train a model without written permission. Third-party photography is used under licence.
7. Links
Where we link outward: for example to the Bank of Thailand’s property price index: we do so because the figure can be checked. We have no control over those sites and take no responsibility for their content.
8. Governing law
This website is published by a Hong Kong company and its content is governed by the law of the Hong Kong Special Administrative Region. That governs the website only. A purchase is made under a separate contract, which names its own governing law and its own forum, and which deals with land in Thailand under Thai law.
Consumers resident in the EU or the UK keep the protections of their own country’s mandatory law, which nothing here removes. We are not obliged to take part in dispute resolution before a consumer arbitration board, and we do not.
